PhoenixRises Terms of Service

PhoenixRises is a personal finance, budgeting, and cashflow app from Dawked Up Productions LLC. Use it as a recordkeeping and planning tool. It is not financial, legal, accounting, tax, investment, or professional advice. You are responsible for reviewing your own records and decisions.

These Terms of Service ("Terms") are a binding agreement between you and Dawked Up Productions LLC ("Dawked Up Productions," "we," "us," or "our"). By accessing PhoenixRises pages, contacting support, downloading the app, or using any PhoenixRises release, you agree to these Terms and the Privacy Policy. If you do not agree, do not use PhoenixRises.

If PhoenixRises is distributed through the Apple App Store, Apple's Licensed Application End User License Agreement also applies to your use of the app. These Terms supplement that standard EULA where allowed.

PhoenixRises is intended to help individuals track budgets, cashflow, categories, accounts, bills, spending, and personal finance patterns. It helps organize information. It does not make financial decisions for you.

PhoenixRises is not a bank, broker, lender, credit repair service, tax preparer, accountant, investment adviser, legal adviser, or emergency financial service. Any summaries, projections, labels, alerts, reports, or calculations are informational only and may be incomplete, delayed, or inaccurate. You should consult qualified professionals before making tax, legal, credit, investment, or major financial decisions.

You retain rights to the budgets, transactions, account names, categories, notes, imports, exports, reports, and other records you create or provide in PhoenixRises. You are responsible for reviewing records before relying on them, keeping backups where appropriate, and using PhoenixRises lawfully.

If you choose to store information about other people in PhoenixRises, you are responsible for having any permission required by law.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use PhoenixRises for your own personal, non-commercial purposes. We reserve all rights not expressly granted.

If PhoenixRises offers paid downloads, subscriptions, trials, or in-app purchases through an app store, the current price, trial period, renewal terms, cancellation process, and refund options will be shown before purchase and handled by that app store. We do not directly process Apple App Store payments or store your payment card details.

Deleting the app may not cancel an app store subscription. Manage app store subscriptions through the account settings provided by that store.

• Do not use PhoenixRises for illegal activity or to store illegal content.
• Do not reverse-engineer, decompile, tamper with, or disrupt PhoenixRises, except where law allows.
• Do not misrepresent PhoenixRises records as reviewed, certified, or guaranteed by Dawked Up Productions.
• Do not use PhoenixRises in a way that violates app store rules or applicable law.

If you send ideas, bug reports, screenshots, logs, or other feedback, you allow Dawked Up Productions to use that material to respond to you, troubleshoot, and improve PhoenixRises without compensation or obligation to implement it.

PhoenixRises pages are hosted by third-party infrastructure providers. If a future app release uses an app store, import provider, backup location, payment processor, or other third-party service, that service may have its own terms and privacy policy. We are not responsible for third-party services outside our control.

PhoenixRises, the website, app design, software, text, graphics, names, logos, and related materials are owned by Dawked Up Productions LLC or its licensors. These Terms do not grant rights in our trademarks or branding.

PhoenixRises is provided "as is" and "as available." To the maximum extent permitted by law, we do not guarantee that PhoenixRises will be uninterrupted, error-free, secure, perfectly accurate, compatible with every device, or suitable for your specific financial, tax, accounting, or business needs. Use PhoenixRises at your own risk.

To the maximum extent permitted by law, Dawked Up Productions LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, missed payments, missed deductions, tax outcomes, credit outcomes, financial losses, or business losses arising from PhoenixRises. To the maximum extent permitted by law, our total liability for any claim relating to PhoenixRises will not exceed the greater of the amount you paid us for PhoenixRises in the 12 months before the claim or ten U.S. dollars (US$10).

We may update these Terms as PhoenixRises evolves. The effective date above will change when the Terms are updated. Continued use after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-law rules. Mandatory consumer-protection rights in your place of residence are not limited by this section.
